Terms and conditions of membership.
DRAFT for review — this is a starting template and must be reviewed and approved (ideally by a solicitor) before it is relied upon.
1. About these terms
These Terms & Conditions govern membership of, and use of the facilities and website of, the Loch Rannoch Highland Club ("the Club"), a timeshare organisation located in Scotland. By becoming a member, booking, or using the Club’s facilities or website, you agree to these terms.
2. Definitions
- "Member" means a person who holds a current membership of the Club.
- "Membership" means the right to occupy a lodge for the week(s) and term attaching to your membership.
- "Lodge" means the self-catering accommodation at the Club allocated to or booked by a Member.
- "Week" means the period of occupation (typically Saturday to Saturday, or the changeover day applicable to your lodge) to which your membership relates.
3. Membership
Membership is subject to the Club’s constitution and rules, the membership documentation issued to you, and any annual maintenance or management charges notified to you. Membership entitlements (including the lodge type, week and term) are as set out in your membership documentation.
4. Bookings and occupation
Members may occupy their lodge for their allocated week(s) and may, subject to availability and the Club’s booking procedures, request additional or alternative weeks. The number of occupants must not exceed the stated capacity of the lodge. Lodges are non-smoking; well-behaved pets are welcome in line with the Club’s pet policy.
5. Charges
Members are responsible for the annual maintenance/management charge and any other fees notified by the Club. Charges are payable by the dates specified. Continued membership and occupation are conditional on these charges being paid up to date.
6. Member conduct
Members and their guests must respect other members, Club staff and the property, must comply with the Club rules and any reasonable instructions of Club staff, and must leave the lodge in a clean and tidy condition. The Club may recover the cost of any damage caused.
7. Transfer and resale of membership
Membership may be transferred, gifted or resold subject to the Club’s rules and any administration requirements. The Club should be notified of any change of ownership so that records and correspondence can be kept up to date.
8. Liability
The Club does not exclude or limit liability where it would be unlawful to do so (including for death or personal injury caused by negligence). Subject to that, the Club is not liable for loss or damage to members’ or guests’ personal property, or for any indirect or consequential loss. Members are encouraged to hold appropriate personal travel and possessions insurance.
9. Website use and booking links
This website is provided for general information. Bookings and certain member services may be handled through third-party systems linked from this site; your use of those systems is subject to their own terms. We make reasonable efforts to keep information accurate but it does not form part of any contract.
10. Privacy
The Club processes personal data in accordance with its Privacy Policy, which forms part of these terms.
11. Changes to these terms
The Club may update these terms from time to time. The current version will always be available on this website, and significant changes will be notified to members.
12. Governing law
These terms are governed by the law of Scotland, and any disputes are subject to the jurisdiction of the Scottish courts.
